Information about the Data Controller

The University of Defence (UoD), as an organisational component of the data controller, is a state higher education institution established by law. In the course of its activities, the UoD processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation), and Act No. 110/2019 Coll., on Personal Data Processing.

Purposes of Personal Data Processing

The purposes for which personal data are processed at the UoD arise primarily from the activities assigned to state higher education institution under the Higher Education Act.

These activities include the delivery of accredited study programmes and lifelong learning programmes; scientific and research activities, development and innovation activities, and other creative activities (hereinafter collectively referred to as “creative activities”); related administrative and operational activities; supplementary activities; and information and promotional activities.

These include applicants for admission, students, graduates, employees, external collaborators and others.

The UoD processes, for example, identification data, contact details, data relating to studies, qualification data, employment data, data relating to creative activities, financial data, operational and location data, and special categories of personal data, such as data concerning health and trade union membership.

Legal Bases for Personal Data Processing

The most common legal bases for processing personal data at the UoD are the performance of tasks carried out in the public interest by a state higher education institution, compliance with a legal obligation and the performance of a contract.

Other legal bases for processing personal data may include the consent of the data subject and the legitimate interests pursued by the UoD.

Disclosure and Transfer of Personal Data

In certain cases, on the basis of law, a contract or the consent of the data subject, the UoD may disclose or transfer personal data to a processor, recipient or third party.

Personal Data Retention Periods

Personal data are processed at the UoD in paper form and in electronic information systems only for as long as is necessary for the relevant purpose. The applicable retention period is determined by law or by the current records management and disposal rules of the Ministry of Defence. Once this period has expired, the personal data are archived or destroyed.

Data Subjects’ Rights and How to Exercise Them

A data subject has the right to request access to their personal data from the data controller, as well as the rectification or erasure of those data or the restriction of processing, where the applicable conditions are met.

A data subject also has the right to object to processing and, where applicable, the right to data portability.

Requests through which data subjects exercise the rights set out above may be submitted in person to the UoD Registry Office, Kounicova 44, 602 00 Brno, or by email to podatelna@unob.cz. Such requests will be assessed and handled in accordance with the GDPR and other applicable legislation.

A data subject may also contact the Ministry of Defence’s Data Protection Officer if they consider that the processing of their personal data infringes the GDPR. This is without prejudice to the data subject’s right to lodge a complaint with the competent supervisory authority, The Office for Personal Data Protection.
